1. Field of application

These General Sales Conditions presented below exclusively determine the contractual relations between the customer, user of the online platform and GP85-Shop.com
Browsing the site with the purchase of a product on the platform implies acceptance of these General Sales Conditions.

2. Contents and Prices

The prices indicated on our platform are presented in Euros, with taxes and fees included. GP85 Shop reserves the right to change prices at any time and without prior notice.
Despite efforts to insert content, GP85 Shop – Tiagolagespina unipessoal lda is not responsible for errors in prices, technical information or descriptions of products on our website.
Whenever an order is received, GP85 Shop – Tiagolagespina unipessoal lda analyzes all the values ​​of the said order and if the value of the product does not correspond to the stipulated value, the customer will be notified, who may choose to pay the difference or cancel the order without any damage to it.

3. Availability and Delivery

GP85 Shop undertakes to respect the delivery deadlines for an order if there is availability in stock.
The average delivery time for an order upon registration and respective payment is subject to the availability and location of our supplier. Any delay in relation to the estimate presented does not confer the right to compensation.
All types of shipment will only be carried out on business days, excluding weekends and holidays.

4. Cancellations and Returns

Failure to pay for the order within 7 (seven) days following the date on which it was placed implies its automatic cancellation.

The customer may cancel his order while it is being processed without prejudice to him. To do so, simply send an email to geral@gp85shp.com stating your intention, with the respective order number.

If the order is in preparation, the customer may also cancel it, however, there will be a cost associated with handling expenses corresponding to 20% of the value of the goods.

Upon receipt of the order by the customer, he may exercise his right of free withdrawal under the legally foreseen terms and indicated below, namely, in Decree-Law n.º 24/2014, of February 14th.

The customer reserves the right to exercise the right of free withdrawal within a maximum period of 14 days from:
Day on which the consumer or a third party, with the exception of the carrier, indicated by the consumer acquires physical possession of the goods, in the case of purchase and sale contracts, or:
Day on which the consumer or a third party, with the exception of the carrier, indicated by the consumer acquires physical possession of the last good, in the case of several goods ordered by the consumer in a single order and delivered separately;
Day on which the consumer or a third party, other than the carrier, indicated by the consumer acquires physical possession of the last lot or element, in the case of delivery of a good consisting of several lots or elements
Day on which the consumer or a third party indicated by him, other than the carrier, acquires physical possession of the first good, in the case of contracts for the periodic delivery of goods during a certain period:
In order to exercise his right of free termination, the customer must communicate to GP85 Shop his decision to terminate this contract by means of an unequivocal statement (for example, registered letter sent by post or e-mail).

In order for the free termination period to be respected, it will suffice that the communication regarding the exercise of the right of free termination be sent to GP85 Shop. before the expiry of the withdrawal period.

In case of exercise of the right of free withdrawal, the customer will be reimbursed for all payments made, including delivery costs, without undue delay and, in any case, no later than 14 days from the date on which the GP85 Shop is informed of the decision to terminate the contract.

We will proceed with refunds using the same payment method that the customer used in the initial transaction, unless expressly agreed otherwise by the customer. In any case, you will not incur any costs as a result of such reimbursement.

GP85 Shop may withhold the refund until it has received the returned goods or until you provide us with proof of sending the goods, whichever occurs first.

Refunds will only be made after checking the condition of the product.

All costs associated with returning the goods, following the exercise of the right of free withdrawal, will have to be borne by the customer in full, as well as handling expenses corresponding to 20% of the value of the goods.

The customer will be responsible for the depreciation of the goods resulting from handling that exceeds what is necessary to verify the nature, characteristics and functioning of the goods.

There is no right of free termination in the following cases:
Supply of goods made according to the consumer’s specifications or clearly personalized;
Supply of goods which, after delivery and by their nature, are inseparably mixed with other articles.Upon return, only products will be accepted under the following conditions:

  • Failure to apply the material;
  • The packaging must be strictly intact as shipped;
    Any material that is returned cannot be damaged in any way;
    Exchanges or returns of batteries are not accepted, except for lack of conformity.

How to return:

After prior contact with GP85 Shop ( geral@gp85shop.com ) and given the instructions for the respective return, you can send us the item properly packaged, with original packaging to the following address: Rua Amália Rodrigues, Nº9A 2695-166 Bobadela – Loures

Any items that have been used will not be accepted.

All items will be checked upon arrival at our service and only those that respect the return conditions will be accepted for exchange or return.

The customer must return the goods without undue delay and no later than 14 days after the day on which he informed GP85 Shop of the free termination of the contract, considering that the same is respected if the customer returns the goods before the expiry of that 14-day period.

In the event of rejection due to non-compliance with the return conditions, the collection of the material will be at the customer’s expense, with a maximum period of 15 working days to collect it. After this period, the material will be considered as abandoned.

5. Warranty and Claims
Claims

These will only be accepted upon verification by our technical department and accompanied by a copy of the invoice, sent to the product manufacturer for analysis.

If the claim is accepted by the manufacturer, we will proceed in accordance with the paragraph below.
Guarantee

All products have a manufacturer’s warranty against defects attributable to their manufacture, and compliance with the guarantee must be required within a period of 6 months after the complaint and such complaint must never exceed 2 years after the purchase. Whenever this occurs, they will be subject to analysis and replaced after approval by the manufacturer, free of charge, except for stock outages, implying a longer period by the Supplier.

The warranties do not include the payment of indemnities or any other expenses required by the malfunction or application/assembly of the products represented by our company.

Warranty Exclusion:

  • The limited warranty does not cover defects caused by the fact that the product is used in conjunction with/or connected to any other product, accessory, or because it is used for a purpose other than that for which it was intended;
  • This guarantee does not apply if the product has been opened, altered or repaired by any entity outside the manufacturer, or if it has been repaired using unauthorized subsequent parts, or if the product serial number is illegible;
  • The guarantee is not applicable when it is intended for competition.
  • The limited warranty does not affect your legal rights (mandatory) as established in national legislation on consumer goods, when applied, (DL nº 67/03 of April 8).

How to claim the guarantee??

To activate the guarantee, you must contact GP85 – TIAGOLAGESPINA unipessoal LDA. by e-mail Geral@gp85shop.com and explain in detail the product defect, indicating the invoice number corresponding to the purchase. You will then receive a response to the situation and if it is necessary to activate the guarantee, you must send the product properly packaged to the address below, indicating the respective assigned process number.

All articles will be checked upon arrival at our service and only those that respect the above mentioned conditions will be accepted for guarantee.

In the event of rejection due to non-compliance with the warranty conditions, the collection of the material will be at the customer’s expense, with a maximum period of 15 working days to collect it. After this period, the material will be considered as abandoned.

6. How to order online?

To place an order online, the customer will first have to open a customer account, enter all the required data. After registration, you must add the desired products in the required quantities to the shopping cart. Once the choice is complete, you must select “Checkout” and follow all the steps regarding the order and respective payment method.

7. Order status

On Hold: awaiting confirmation of product in stock or in case of order, the customer will be informed before payment.

Pending payment: The customer has up to 7 days to make the payment for my existing ones, after which the order will be automatically cancelled.

Processing: the order has been paid and GP85 is preparing the order, in case of shipment you will be informed that it has been sent, or in case of collection at our store you will be informed that it is ready for collection

Completed: Your order has been delivered or picked up.
